MEMORANDUM AND ORDER regarding Petition for Writ of Habeas Corpus1 filed by David Gonzales. Upon initial review of the petition, the court preliminarily determines that Petitioner's Claims One, Two, Three, and Four are potentially cognizable in federal court. The court determines that Claims Five, Six, and Seven are not cognizable in a federal court habeas action and are therefore dismissed. Clerk to mail copies. By November 23, 2009, Respondent shall file a motion for summary judgment or state court records in support of an answer.
