TENTATIVE FINDINGS OF FACT regarding Revised Presentence Investigation Report as to defendant Shane Sleister. It is ordered that:... (2)Even if I assume that every fact stated in the defendant's sentencing memorandum 37 is true, a variance is unwarranted. The enhanced sentence arising from the defendant's possession of an AR-15 assault rifle and an AK-47 assault rifle, together with six magazines holding 30 rounds each, after having been convicted of various drug offenses, coupled with a significant history of drug and alcohol abuse, strongly indicate that a Guidelines sentence of 30 months in prison is both appropriate and needed to address all of the statutory goals of sentencing. Accordingly, the variance motion 35 is denied.(3)Except to the extent (if at all) that I have sustained an objection or granted a motion or reserved an issue for later resolution in the preceding paragraph, the parties are herewith notified that my tentative findings are that the presentence report is correct in all respects.
