FINDINGS AND RECOMMENDATION AND ORDER to the Honorable Joseph F. Bataillon, Senior United States District Judge, that the Motion to Suppress 16 be granted in part and denied in part. The clerk shall cause a transcript of the hearing to be prepared and filed. Pursuant to NECrimR 59.2, any objection to the magistrate's Findings and Recommendation shall be filed with the Clerk of the Court within fourteen (14) days after the unredacted transcript is available to counsel. ORDER granting Bassette's 33 Motion to Continue trial as to Howard Bassette III (1). Trial of this matter is re-scheduled for August 10, 2015, before Senior Judge Joseph F. Bataillon and a jury. The ends of justice have been served by granting such motion and outweigh the interests of the public and the defendant in a speedy trial. The additional time arising as a result of the granting of the motion, i.e., the time between June 17, 2015, and August 10, 2015, shall be deemed excludable time in any computation of time under the requirement of the Speedy Trial Act for the reason that defendants counsel requires additional time to adequately prepare the case.
