MEMORANDUM AND ORDER - IT IS ORDERED The defendant's motion for a judgment of acquittal or new trial (Filing No. 424 in 8:13CR107) is denied. The defendant's motion for a judgment of acquittal or new trial (Filing No. 41 in 8:15CR44) is granted with respect to Count I and denied with respect to Count II). The defendant's motion to vacate (Filing No. 42 in 8:15CR44) is denied as moot. The court accepts the jury's verdict on Counts I and II in Case No. 8:13CR107. The court will accept the jury's verdict on Count II in Case No. 8:15CR44, but finds insufficient evidence to support the jury's verdict on Count I in Case No. 8:15CR44.
