The defendant is given until on or before August 15, 2016, in which to file pretrial motions. The time between July 28, 2016, and August 15, 2016, shall be deemed excludable time in any computation of time under the requirement of the Speedy Trial Act. The trial date of August 30, 2016, is canceled and will be rescheduled following the disposition of any pretrial motions or the expiration of the pretrial motion deadline. PRELIMINARY ORDER OF FORFEITURE as to defendant Nestor Alvarez. The United States' Motion for Preliminary Order of Forfeiture, ECF No. 52, is granted. Based upon the Forfeiture Allegation of the Indictment and the Defendant's plea of guilty, the United States is hereby authorized to seize the $34,974.00 in United States currency. The Defendant's interest in the aforementioned currency is hereby forfeited to the United States for disposition in accordance with the law, subject to the provisions of 21 U.S.C. § 853(n)(1). The aforementioned currency is to be held by the United States in its secure custody and control. Upon adjudication of all third-party interests, this Court will enter a Final Order of Forfeiture pursuant to 21 U.S.C. §853(n), in which all interests will be addressed.
