MEMORANDUM AND ORDER that plaintiff and counter-defendant Federal Insurance Company's Motion for Summary Judgment (Filing No. 85) is granted. Defendant and counter-claimant COR Clearing, LLC's claim for reimbursement under the financial institution bond is not covered. COR Clearing, LLC's counterclaim is dismissed with prejudice. COR Clearing, LLC's Motion for Partial Judgment on the Pleadings (Filing No. 50) and Motion to Strike (Filing No. 77) are denied as moot. Federal Insurance Company's Motion to Extend Discovery Deadlines (Filing No. 56) and Motion to Stay the Motion for Partial Judgment on the Pleadings (Filing No. 60), as well as the parties' joint Motion to Continue the Trial Date (Filing No. 99) are denied as moot.
