ORDER granting the defendant's unopposed 15 Motion to Continue Trial as to Vicente Velazquez (1). Jury Trial is continued to 4/11/2017 at 09:00 AM in Courtroom 2, Roman L. Hruska Federal Courthouse, 111 South 18th Plaza, Omaha, NE before Chief Judge Laurie Smith Camp. In accordance with 18 U.S.C. § 3161(h)(7)(A), the court finds that the ends of justice will be served by granting this continuance and outweigh the interests of the public and the defendant in a speedy trial. Any additional time arising as a result of the granting of this motion, that is, the time between todays date and April 11, 2017, shall be deemed excludable time in any computation of time under the requirement of the Speedy Trial Act. PRELIMINARY ORDER OF FORFEITURE that the United States' Motion for Preliminary Order of Forfeiture, ECF No. 24, is granted. Based upon the Forfeiture Allegation of the Indictment and the Defendant's plea of guilty, and the parties' Stipulation, the United States is hereby authorized to seize the $6,300.00 in United States currency. Upon adjudication of all third-party interests, this Court will enter a Final Order of Forfeiture pursuant to 21 U.S.C. § 853(n), in which all interests will be addressed as to defendant Vicente Velazquez. JUDGMENT as to Vicente Velazquez. The defendant is hereby committed to the custody of the United States Bureau of Prisons to be imprisoned for a term of one hundred fifty (150) months on counts I, II, III, IV and V, said terms to run concurrently. Upon release from imprisonment, the defendant shall be on supervised release for a term of four (4) years on counts I and V and 3 years on counts II, III and IV, to be served concurrently. A $500.00 special assessment is imposed. The defendant is remanded to the custody of the United States Marshal. Ordered by Chief Judge Laurie Smith Camp. (4 Certified copies to USM) (KMG)
