ORDER that the Defendant's trial remains set for August 20, 2018, at 9:00 a.m., or as soon thereafter as the case may be called, for a duration of four (4) days. Trial will be held in the Special Proceedings Courtroom of the Roman L. Hruska Federal Courthouse, Omaha, Nebraska. Jury selection will be held at commencement of trial. The Court finds that the ends of justice served by continuing the trial outweigh the interests of the public and Defendant in a speedy trial. The additional time arising as a result of the granting of the motion to continue, the time between when the unopposed motion to continue trial was filed, May 30, 2018, and the new trial date of August 20, 2018, shall be deemed excludable time in any computation of time under the requirements of the Speedy Trial Act because although counsel have been duly diligent in these proceedings, additional time is needed to adequately prepare this case for trial and failing to grant additional time could result in a miscarriage of justice. 18 U.S.C. ยง 3161(h)(1) & (h)(7). Failure to timely object to this Order, as provided under this Courts Local Rules, will be deemed a waiver of any right to later claim the time should not have been excluded under the Speedy Trial Act.
