REPORT AND RECOMMENDATION re 14 Motion for Summary Judgment, recommending respondent's motion for summary judgment, (Doc. No. 14) should be granted in part, to the extent Lewis seeks credit against his federal sentence for time spent in state custody on April 14 and 15, 2009, and otherwise denied. Further, the district judge should grant the petition for a writ of habeas corpus, and direct the BOP to credit Lewis's sentence for the time spent in custody between April 16, 2009 and January 1, 2010, unless respondent can show cause why the petition should not be granted or Lewis not be credited as recommended, within fourteen days of the date of this Report and Recommendation. Follow up on Objections to R&R on 2/13/2018. The court only follow up date DOES NOT include 3 additional days that may apply per FRCP 6(d) and FRCrP 45(c). So Ordered by Magistrate Judge Andrea K.
