OPINION/ORDER granting 17 Motion to Dismiss partial dismissal of the Complaint. Counts One, Two, Three, and Five are dismissed WITH PREJUDICE. Counts Six, Seven, Eight, and Nine are dismissed WITHOUT PREJUDICE. Plaintiff shall have forty-five (45) days to file an amended complaint as to those counts dismissed without prejudice if he intends to do so. The Court DENIES 21 Motion to Dismiss the Individual Defendants for insufficient service of process. Plaintiff has forty-five (45) days to effectuate proper service; it is further ORDERED that the Clerk of the Court shall serve a copy of this Order upon Plaintiff by certified mail return receipt.
