LETTER OPINION AND ORDER that Plaintiffs application to proceed in forma pauperis is GRANTED and the complaint is DISMISSED without prejudice pursuant to 28 U.S.C. ยง 1915(e)(2)(B) for failing to state a claim upon which relief can be granted, and for lack of subject matter jurisdiction pursuant to Fed. R. Civ. P. 12(h)(3). Plaintiff may file an amended complaint within 30 DAYS of receipt of this Letter Opinion and Order.
