MEMORANDUM AND ORDER: The Court orders as follows: 1) All parties, including those not involved in the Beth Din arbitration, shall appear before the court on 5/28/08, at 11 AM; 2) At that court appearance, Herbst shall show cause why the arbitration award should not be confirmed pursuant to Section 9 of the FAA; 3) In the event that Herbst fails to appear, Brach's motion to confirm the arbitration award shall be granted on default. In addition, Herbst may be subject to sanctions for failure to comply with the court's Order; 4) On or before 5/7/08, Brach or his counsel shall cause this Order to be served on Herbst in a manner consistent with the requirements of Federal Rule of Civil Procedure 4(e); 5) Any and all submissions concerning the confirmation of the arbitration award shall be served on all parties and filed with the court on or before 5/16/08. MEMORANDUM AND ORDER: Plaintiff Eluzer Stein is hereby Ordered to show cause, in writing, on or before June 11, 2008, why the court should not dismiss his claims for failure to prosecute. If Stein fails to comply with this Order, the court shall dismiss his pending claims pursuant to Federal Rule of Civil Procedure 41(b). If, however, Stein files a written response to this Order within the time prescribed herein, Stein shall appear, together with all defendants against whom Stein has asserted claims (James Herbst, Rhoda Herbst, Stuart Davis, Jon Lefkowitz and Cosmopolitan Capital Corporation), for a conference before the court on June 18, 2008, at 2:30 p.m. The Clerk of the Court is directed to serve a copy of this Order on Stein at Stein's known address, which was provided by Mr. Klatsky at the court's request (Docket No. 230).
