Upon consideration, the Report and Recommendation is hereby ADOPTED IN FULL. Accordingly, it is hereby ORDERED that plaintiff's claims against Defendant Isis Surface Mounting Inc. a)ORDER DENYING Defendant's 72 Motion to Dismiss; AND GRANTING IN PART AND DENYING IN PART Plaintiff's 73 Motion for Summary Judgment -- For the reasons set forth in the ATTACHED WRITTEN MEMORANDUM AND ORDER, the court holds that Defendant breached its contract with Plaintiff and, thus, GRANTS Plaintiff's motion for summary judgment in part, and DENIES Defendant's motion for summary judgment. However, while the court finds that Plaintiff is entitled to certain damages, Plaintiff's motion for damages in the amount of $382,773.31 is DENIED, as the court finds that Plaintiff does not qualify as a lost-volume seller. Moreover, Plaintiff's request for attorneys' fees is DENIED. This matter is hereby referred to U. S. Magistrate Judge Cheryl L.
