MEMORANDUM AND ORDER, For the foregoing reasons, Jones's application for a writ of habeas corpus is denied and his petition is dismissed. Since Jones has not made a substantial showing of the denial of a constitutional right, a certificate of appealability shall not issue. The Court certifies pursuant to 28 USC sec. 1915(a) that any appeal from a judgment denying this petition would not be taken in good faith and therefore in forma pauperis status should be denied for purposes of an appeal.
