MEMORANDUM AND ORDER, for the reasons set forth herein, the writ is denied and the petition dismissed. Because Shuford has not made a substantial showing of a denial of a constitutional right, a certificate of appealability shall not issue with respect to any of Shuford's claims. Additionally, the Court certifies pursuant to USC sec. 1915(a) that any appeal from this Memorandum and Order would not be taken in good faith and therefore in forma pauperis is denied for the purpose of any appeal.
