Stone v. NYC Transit et al
ORDER granting 54 Motion for Summary Judgment. The court finds that, even if plaintiff can establish a prima facie case of discrimination, the undisputed proof is that defendant would have dismissed plaintiff regardless of his impairment for an independent, nondiscriminatory reason. Defendant's motion for summary judgment is therefore granted. The Clerk of Court is directed to enter judgment for defendant. Ordered by Judge Nina Gershon on 03/26/08. (Lee, Donna)
