ORDER directing that not later than November 4, 2005, attorney Ardith Bronson and the law firm of Weil, Gotshal & Manges and all partners and employees of Weil, Gotshal & Manges who have had contact with Ms. Bronson in connection with the allegations set forth in this Memorandum and Order shall submit sworn statements to the court as to the circumstances that led to Ms. Bronson's refusal to serve as a suretor in this matter, including, but not limited to discussions regarding the impact, if any, that her involvement with her father's criminal proceedings would have on the terms and conditions of her employment at Weil, Gotshal & Manges. Specifically, his motions to dismiss Counts One and Three in the Superseding Indictment are DENIED, and his motions to dismiss Counts Two and Four in the Superseding Indictment are GRANTED. As per the attached Order, Defendant is noticed that the court is considering an upward departure based on information provided to the court by the U.S. Probation Department in the Pre-Sentence Investigation Report indicating Defendant's involvement in a racketeering conspiracy that included obstructing justice, tampering with witnesses, bribing and attempting to bribe witnesses, his facilitating retaliation against a witness/informant, and his attempt to disguise the source of proceeds from an illegal drug operation.
