PRELIMINARY ORDER OF FORFEITURE as to Louis Sito. Dft shall forfeit to the U.S. the Forfeiture Money Judgment. Dft agrees to pay $30,000 within 90 days of pleading guilty. A second partial payment of $30,000 towards the Forfeiture Money Judgment shall be due within six months of the plea. The balance of the Forfeiture Money Judgment shall be 30 days before sentencing. REPORT AND RECOMMENDATIONS as to Louis Sito, respectfully recommending that defendants be directed to pay restitution to the 30,724 advertisers to be identified by the government in the amounts that Newsday and Hoy have already determined to be due them, totaling $5,966,000, and that no pre-judgment interest be awarded. I further recommend that the court find that (1) any additional victims either cannot be identified, or that the calculation of their losses is, in effect, not practicable and that the losses, if they could be calculated, would likely be relatively small; and (2) therefore, that attempting to identify these victims or determine their losses "would complicate or prolong the sentencing process to a degree that the need to provide restitution to any victim is outweighed by the burden on the sentencing process." 18 U.S.C. ยง 3663A(c)(3). MEMORANDUM AND ORDER ON RESTITUTION as to Louis Sito for 54 Report and Recommendations. There is no need to order restitution in these cases. Most victims have been made whole. Providing restitution to a relatively few who did not receive compensation for small amounts will prolong the sentencing process to a degree that the need to provide restitution is outweighed by the burden on the sentencing process.
