REPORT AND RECOMMENDATIONS, Pendagrass and Meekins have failed to respond to pltff's complaint. The Court's Orders specifically warned defts that if they failed to respond to pltff's complaint by 7/6/07, I would recommend that the Court should enter a default judgment against them. Accordingly, I hereby recommend that the Court should enter a default judgment against Pendagrass and Meekins pursuant to FRCP 55(a). REPORT AND RECOMMENDATIONS ON DEFTS' MOTION FOR SUMMARY JUDGMENT, that defts' 37 MOTION for Summary Judgment should be granted and pltff's 1 Complaint against these defts should be dismissed. It is further recommended that for the purpose of an in forma pauperis appeal, the Court should certify pursuant to 28 USC sec. 1915(a)(3) that any appeal from a judgment enetered herein would not be taken in good faith. ORDER ADOPTING 60 REPORT AND RECOMMENDATION: Defendants City of New York and Police Officer Suarez moved for summary judgment, and pursuant to 28 U.S.C. § 626(b), the Court referred the motions to Magistrate Judge Bloom for Report and Recommendation. On 8/14/08, Magistrate Bloom issued a Report recommending that defendants' motions for summary judgment be granted. On 8/20/08, plaintiff wrote to the Court requesting a 60 day extension of time to file objections. The Court granted plaintiff an extension until 10/24/08. As of 10/28/08, no objections have been filed, and so the Court adopts the Report in full. Defendants' motion for summary judgment is granted. C/M. Ordered by Chief Judge Raymond J. ORDER ADOPTING 61 REPORT AND RECOMMENDATION: On 8/18/07, the Court adopted Magistrate Judge Bloom's Report & Recommendation, thereby granting plaintiff's motion for default judgment against defendants Meekins and Pendergrass. Those defendants requested reconsideration, and the Court afforded them 10 days to file a motion to vacate the default. Pursuant to 28 U.S.C. § 626(b), that motion was referred to Magistrate Judge Bloom, and on 8/14/08, Magistrate Judge Bloom issued a Report & Recommendation recommending that the default judgment be vacated. On 8/20/08, plaintiff wrote to the Court requesting a 60 day extension of time to file objections. The Court granted plaintiff an extension until 10/24/08.
