ORDER granting 43 Motion for Extension of Time to File; granting in part and denying in part 16 Motion to Certify Class --- For the reasons set forth in the ATTACHED WRITTEN MEMORANDUM AND ORDER, plaintiffs' motion for an extension of time under Rule 6(b) to file affidavits is GRANTED, and plaintiffs' motion for preliminary collective action certification under Section 216(b) of the Fair Labor Standards Act is GRANTED as to those delivery drivers and customer service representatives who worked at the Coney Island Store within the past three years, i.e., between May 30, 2005 and May 30, 2008, AND is DENIED as to employees from the other Brooklyn area stores named in the complaint. Within ten business days from the date of this Order, i.e., by June 13, 2008, plaintiffs are directed to amend the "Notice of Lawsuit" and submit the amended version for the court's approval, and defendant is directed to produce the name and last known address of each potential plaintiff.
