REPORT AND RECOMMENDATION: It is respectfully recommended that defendants' 30 motions to dismiss should be granted and the complaint should be dismissed. The Court should grant plaintiffs 20 days from the adoption of this Report of Recommendation to file a Second Amended Complaint. If plaintiffs fail to file a second amended complaint within the time allowed, judgment should be entered dismissing the action. Finally, the Court should certify pursuant to 28 U.S.C. ยง 1915(a)(3) that any appeal from a judgment entered herein would not be taken in good faith for the purpose of denying plaintiffs' in forma pauperis status on appeal. ORDER (ADOPTING REPORT AND RECOMMENDATION): This Court has received the 35 Report and Recommendation of Magistrate Judge Lois Bloom dated 5/23/2008, recommending that this Court grant defendant's 30 motion to dismiss plaintiffs' claims with leave to replead the ECOA claim only. No party has objected to the Report and Recommendation. The Court adopts the Report and Recommendation of October 22, 2007 as its opinion.
