MEMORANDUM & ORDER granting Budget Defendant's 16 Motion to Dismiss. Because Congress has, through the Graves Amendment, constitutionally preempted state laws imposing vicarious liability on rental-car companies, Flagler cannot state cognizable claims against Budget.
