ORDER granting 19 Motion to Dismiss. Defendant's motion to dismiss is granted, and plaintiff's claims against the City of New York are dismissed with prejudice. The Clerk of Court is directed to enter judgment for the defendant. Plaintiff, however, is given 30 days leave to amend the caption of his amended complaint, if he wants to include the name(s) of the individual police officer(s) identified or described in connection with his arrest on October 7, 2005. If plaintiff fails or chooses not to amend his complaint within 30 days of this order, the court shall direct the Clerk of Court to close this case, as all the claims against the named defendant have been dismissed.
