OPINION AND ORDER: The 1 petition for a writ of habeas corpus is denied. Because petitioner has failed to make a "substantial showing of the denial of a constitutional right," 28 U.S.C. ยง 2253(c)(2)(1996), no Certificate of Appealability will be granted. OPINION AND ORDER: The Court withholds its decision on petitioner's 9 motion for reconsideration. The Court orders petitioner to show cause why he should be granted a stay by serving and filing within 30 days of the date of this Order a submission setting forth his reasons for why he has established "good cause" for his failure to exhaust his ineffective assistance of counsel claim in state court.
