MEMORANDUM and ORDER: Plaintiff's action is dismissed for lack of jurisdiction pursuant to Fed. R. Civ. P. 12(h)(3). See 28 U.S.C. § 1915(e)(2)(B). Having provided plaintiff with an opportunity to replead, see Cruz v. Gomez, 202 F.3d 593, 596 (2d Cir. 2000), plaintiff's amended complaint fails to demonstrate that this Court has jurisdiction so the Clerk of Court is directed to close this case. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal would not be taken in good faith and, therefore, in forma pauperis status is denied for the purpose of any appeal. Coppedge v. United States, 369 U.S. 438, 444-45 (1962). Ordered by Judge Sandra L. Townes on 07/07/2008. (Pastore, F. Alan) (Chambers mailed hard copy to pro se plaintiff.)
