MINUTE ENTRY AND ORDER: The Court held a telephone status conference on March 28, 2017. Frederick Brewington appeared on behalf of Plaintiff. Thomas Deas appeared on behalf of defendant MTA Bus Company. Defendant waived its right to submit a written response to Plaintiff's objection 89 to Magistrate Judge Orenstein's March 2, 2017 report and recommendation 88. For the reasons set forth in the attached order, the Court adopted Magistrate Judge Orenstein's report and recommendation as the opinion of this Court. Defendant's motion to dismiss this action 79 pursuant to Fed. R. Civ. P. 25(a)(1) is granted in its entirety. The Clerk of Court is directed to enter judgment and close this case accordingly.
