ORDER as to Choudry Muhammad Khalil: As set forth in the attached written ORDER, another Apprendi issue is raised by the series of counts under 18 USC section 1028. The parties shall provide their respective positions on this issue by letter no later than 9:00 a.m. on Monday, April 27, and provide revised proposed jury instructions for these counts as appropriate.The government is also reminded that the Court directed preparation of a revised Verdict Sheet incorporating previous Apprendi issues. That revised Verdict Sheet, to incorporate any revisions required pursuant to this Order, shall also be filed by 9:00 a.m. on Monday, April 27. Ordered by Judge Roslynn R. Mauskopf on 4/25/2015.
