MEMORANDUM AND ORDER granting in part and denying in part 83 Motion for Summary Judgment: For the reasons stated in the attached Memorandum and Order, the defendants summary judgment motion is granted in part and denied in part. Specifically, Freires claims for false arrest, malicious prosecution, failure to intervene, and municipal liability are dismissed. Freire's claim of deliberate indifference to medical needs as against Detective Gutierrez, EMT Moldovan, and EMT Tapia is likewise dismissed. Freire's claim of excessive force as against Detective Zamot, and his claim of deliberate indifference to medical needs as against Sergeant D'Onofrio, survive.The City is ordered to serve a copy of this Memorandum and Order on Freire within ten days of the date of this order, and file proof of service with the Court forthwith upon so doing.This case is recommitted to the assigned magistrate judge for all remaining pre-trial proceedings.
