MEMORANDUM & ORDER: For the reasons set forth in the attached, the Court GRANTS 12 Plaintiff's motion for judgment on the pleadings and DENIES 16 the Commissioner's cross-motion. The Court reverses the decision of the Commissioner and remands this case for further proceedings consistent with this opinion. ORDER: For the reasons stated in the attached, it is hereby ordered that Plaintiff's motion for attorneys' fees 25 under 42 U.S.C. ยง 406(b) is granted in part, and Binder is awarded $9,850 in attorneys' fees. Upon receipt of this award from the government, Binder shall promptly refund Plaintiff $3,600, which represents the EAJA fees already received by counsel. The case remains closed.
