MEMORANDUM AND ORDER: Sprint elicited evidence suggesting defendants business was not always on the up-and-up. But Yusupovs petulant deposition testimony, the fact that iCell Guru bought bad ESN phones (allegedly for parts), and the existence of counterfeiting materials at iCell Gurus place of business does not establish what is necessary for Sprint to recover under the Lanham Act and New York unfair competition law: that iCell Guru actually sold bad ESN Sprint phones. The Court therefore concludes that Sprint is not entitled to any damages. Ordered by Judge Frederic Block on 4/28/2017. (Innelli, Michael)
