ORDER granting 27 Motion to Dismiss for Failure to State a Claim: For the reasons stated in the attached Memorandum & Order ("M&O"), Defendant's motion to dismiss is granted, with prejudice as to Plaintiff's malicious prosecution claims, and without prejudice as to all other claims asserted by Plaintiff. Plaintiff shall have thirty (30) days from the date of this M&O in which to file an amended complaint as to the claims dismissed without prejudice. If Plaintiff fails to file an amended complaint by that date, the Court will direct the Clerk of Court to terminate this action. Ordered by Judge Pamela K. Chen on 2/16/2016. (Levanon, Neta)
