ORDER ADOPTING REPORT AND RECOMMENDATION: Pursuant to 28 U.S.C. ยง 636(b) and Federal Rule of Civil Procedure 72, the Court has reviewed the R&R (Doc. No. 45) for clear error and, finding none, concurs with the R&R in its entirety. See Covey v. Simonton, 481 F. Supp. 2d 224, 226 (E.D.N.Y. 2007). MEMORANDUM AND ORDER granting in part and denying in part 64 Motion for Summary Judgment: For the reasons stated in the attached Memorandum and Order,the defendants' motion for partial summary judgment (Doc. No. 64) is granted in part and denied in part. Rao's false arrest claim as to all defendants is dismissed. Rao's remaining claims are: (1) abuse of process as to defendant Warmhold only; (2) excessive force, assault and battery and failure to intervene against defendants Warmhold, Gridley and Cabrera. This case is recommitted to Magistrate Judge Bloom for all remaining pre-trial proceedings. Ordered by Judge Roslynn R. Mauskopf on 3/29/2018. (Mauskopf, Roslynn)
