MEMORANDUM & ORDER: Plaintiff's 2 request to proceed in forma pauperis is granted. The Complaint is dismissed for failure to state a claim pursuant to 28 U.S.C. § 1915(e)(2)(B). Plaintiff is granted leave to file an amended complaint 30 days from the date of this Memorandum and Order. Plaintiff is advised that if she files an amended complaint, it will completely replace the original Complaint. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal would not be taken in good faith and therefore in forma pauperis status is denied for purpose of an appeal. MEMORANDUM & ORDER ADOPTING REPORT AND RECOMMENDATION: By 49 Report & Recommendation dated 2/8/2018 ("R&R"), Judge Bloom recommended that the Court grant Defendant's motion for summary judgment. The Court adopts the 49 R&R in its entirety and grants Defendant's motion for summary judgment. The Court grants Defendant's 35 motion for summary judgment as to all of Plaintiff's claims and dismisses the Amended Complaint in its entirety. The Clerk of Court is directed to close this case.
