ORDER re 82. As explained in the attached Order, the defendants shall produce the outstanding discovery materials by 12/18/2017. The defendants may submit appropriate affidavits to meet their burden of demonstrating undue burden or expense by 12/15/2017 and the Court will consider whether defendants have met their burden. The defendants are free to apply to the district court for leave to file a motion for summary judgment, but any such application must explicitly notify the district judge that defendants' request is untimely under the terms of this Court's prior Order and they shall set forth "good cause" for their untimely filing so that the district judge may consider their request. The Court has scheduled a status conference to facilitate the expeditious resolution of any outstanding discovery disputes not resolved by this Order for 12/20/2017 at 12:00 PM in Courtroom 13B South. MEMORANDUM DECISION AND ORDER. I adopt Judge Pollak's R&R in part. The City is to pay all reasonable expenses incurred as a result of the defendant's discovery failures; these expenses include fees associated with additional depositions of witnesses who have already been deposed, depositions of newly identified witnesses, and attorneys' fees in connection with depositions and the sanctions motion.
