MEMORANDUM & ORDER: The Court grants Plaintiff's 2 application to proceed in forma pauperis pursuant to 28 U.S.C. § 1915(a). The Court dismisses the Complaint pursuant to 28 U.S.C. § 1915(e)(2)(B)(ii). Plaintiff is granted leave to file an amended complaint within 30 days of the date of this Memorandum and Order. Plaintiff is advised that if he files an amended complaint, it will completely replace the original Complaint. The amended complaint must be captioned "Amended Complaint" and bear the same docket number as this Memorandum and Order. If Plaintiff fails to amend his Complaint within 30y days as directed by this Memorandum and Order, the Court shall dismiss this Complaint for failure to state a claim on which relief may be granted. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this Memorandum and Order would not be taken in good faith and in forma pauperis status is therefore denied for the purpose of an appeal. MEMORANDUM AND ORDER granting in part and denying in part 19 defendant's motion to dismiss. For the reasons discussed in the attached Memorandum and Order, the Court denies the motion to dismiss plaintiff's failure to promote claim and grants the motion to dismiss plaintiff's retaliation and remaining discrimination claims. The Court revokes plaintiff's IFP status and orders plaintiff to retroactively pay all of the applicable court fees. The Clerk of Court is directed to provide plaintiff with a list of the expenses incurred as a result of his IFP application. Ordered by Judge Margo K. Brodie on 12/29/2017. (Djabarova, Zamira)
