ORDER granting in part and denying in part 37 Motion to Dismiss --- For the reasons set forth in the ATTACHED WRITTEN OPINION AND ORDER, Defendants' motion is granted in part and denied in part. Summary judgment is denied only as to the alleged use of excessive force surrounding Plaintiffs handcuffing. All other claims are dismissed. This matter is referred to the magistrate judge for further pretrial proceedings, including settlement discussions. In light of the Court's decision on Defendant's dismissal motion, if no settlement is possible, then an amended joint pretrial order shall be filed at a date to be set by the magistrate judge.
