MEMORANDUM AND ORDER ON DEFENDANT'S MOTION TO DISMISS PURSUANT TO FED R. CIV. P 12(b)(6), denying 11 Motion to Dismiss for Failure to State a Claim. Discovery shall be expedited. The parties shall make any summary judgment motions returnable October 18, 2017. Briefing schedules shall be arranged by counsel, with the help of the magistrate judge if necessary. A "Science Day" will be held on October 18 and 19, 2017. Experts and demonstrations shall indicate what methods can be used to satisfy plaintiffs' needs, their costs, advantages and disadvantages, and other relevant considerations, such as workable, flexible definitions. The court is not at present contemplating class certification for the reasons stated orally on the record, but it will hear argument on this issue on "Science Day." Ordered by Judge Jack B.
