MEMORANDUM & ORDER [DISMISSING CASE]: The Court grants Plaintiff's 2 application to proceed in forma pauperis pursuant to 28 U.S.C. § 1915 solely for the purpose of this Memorandum and Order. Accordingly, the Court dismisses the Complaint for lack of subject matter jurisdiction. Because the Court lacks subject matter jurisdiction over Plaintiff's claim, any amendment to the Complaint would be futile. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this Order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal.
