MEMORANDUM AND ORDER: Plaintiff William Escalera's 2 request to proceed in forma pauperis is granted. Accordingly, Escalera's claims against the City of New York and the New York City Department of Correction are dismissed. No summons shall issue as to these defendants. Escalera's claim against Officer Lorezano may proceed. The Court certifies pursuant to 28 U.S.C. ยง 1915(a)(3) that any appeal from this order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of an appeal. The United States Marshals Service is directed to serve the summons, the complaint, and a copy of the instant Memorandum and Order upon defendant Correction Officer Lorezano, Shield No. 5303, who is alleged to be a Correction Officer employed by the New York City Department of Correction at the Robert N. Davoren Complex on Rikers Island, without prepayment of fees. SO ORDERED by Judge Roslynn R. Mauskopf, on 12/20/2017. C/mailed. (Received for docketing on 1/16/2018) Parties: City of New York and Department of Corrections terminated. (Latka-Mucha, Wieslawa)
