ELECTRONIC ORDER DENYING DEFENDANTS' 135 Motion to Dismiss --- For the reasons set forth in the ATTACHED WRITTEN MEMORANDUM AND ORDER, Defendants' motion to dismiss pursuant to Fed. R. Civ. P. 12(b)(7) and 19(a) for failure to join a necessary party and Fed. R. Civ. P. 17(a) for failure to prosecute this action in the name of the real parties in interest, is DENIED in its entirety. This matter is referred to the magistrate judge for further pretrial proceedings and for settlement negotiations. The Clerk of the Court shall serve a copy of this Electronic Order and the ATTACHED WRITTEN MEMORANDUM AND ORDER on pro se plaintiff by mailing a copy thereof by certified mail with return receipt.
