ORDER DENYING IN PART AND GRANTING IN PART DEFENDANT'S 17 Motion for Summary Judgment --- For the reasons set forth in the ATTACHED WRITTEN MEMORANDUM AND ORDER, defendant's motion for summary judgment is DENIED as to plaintiff's Title VII / Pregnancy Discrimination Act and New York Human Rights Law claims. However, defendant's motion is GRANTED to the extent that plaintiff's FMLA claim is DISMISSED, but WITHOUT PREJUDICE TO REPLEAD this claim within twenty days of the date of this Order, i.e., by August 15, 2006.
