MEMORANDUM AND ORDER: For the reasons set forth in the attached Memorandum & Order, petitioner has demonstrated no basis for relief under 28 U.S.C Section 2254. Petitioner has failed to point to any State court ruling that was contrary to, or an unreasonable application of, clearly established federal law, or that resulted in a decision that was based on an unreasonable determination of the facts in light of the evidence presented in the State court proceeding. Accordingly, the instant habeas petition is DENIED. Because petitioner has failed to make a substantial showing of a denial of a constitutional right, no certificate of appealability shall issue. SO ORDERED. Ordered by Judge Joseph F. Bianco on 5/21/08. (Totino, MaryAnn)
