MEMORANDUM AND OPINION: For the reasons contained in the attached Memorandum Opinion and Order, defendant's motion for a protective order with respect to the three privileged emails inadvertently produced to the pro se plaintiff is granted. Plaintiff is directed to return all copies of the inadvertently produced documents in his possession to defendant within ten (10) days of the date of this Order. Any and all portions of plaintiff's opposition to defendant's motion for summary judgment that refer to or are based on the privileged documents are stricken, including, inter alia, the documents themselves that plaintiff attached as exhibits. Defendant's counsel is directed to serve a copy of the attached Memorandum Opinion and Order on the pro se plaintiff upon receipt. Ordered by Magistrate Judge E. Thomas Boyle on 4/28/08.
