MEMORANDUM AND ORDER: For the reasons set forth in the attached Memorandum & Order and orally on the record in Court, (1) the defendant's motion to suppress is denied; (2) the government's motion in limine to admit certain evidence is (a) granted as to the evidence regarding the prior interactions between defendant and the owners of Roseanne's (including the alleged threats), as well as the alleged unsuccessful attempt to have the owners of Roseanne's assaulted; and (b) denied as to the illegal gambling evidence; and (3) the government's motion in limine to preclude evidence regarding defendant's offer to take a polygraph and any reference by defense counsel during the trial regarding the penalties for Count Three is granted. MEMORANDUM AND ORDER: For the reasons set forth in the attached Memorandum and Order, the Rule 29 motion for a judgment of acquittal on Count Three is GRANTED.
