OPINION AND ORDER granting in part and denying in part 12 Motion to Dismiss. For the reasons stated herein, the branches of dft's motion seeking dismissal of plffs' negligence, strict product liability and fraud claims (first, second and fifth causes of action) are granted and those claims are dismissed as time-barred; and the motion is otherwise denied without prejudice. The parties are directed to appear at 1010 Federal Plaza, Central Islip, New York on November 12, 2008 at 11:30 AM for a settlement and/or scheduling conference with authority or persons with authority to resolve this action.
