MEMORANDUM and ORDER granting 13 Motion to Dismiss the claims pursuant to Section 1983, as well as all claims alleged pursuant to the New York State Human Rights Law. The Court also dismisses all claims as to Defendant Chief Joseph Wing. Plaintiff's Title VII claims of disparate treatment based upon race and gender may proceed to discovery. If the parties have not already done so, they are directed to contact the Magistrate Judge to whom this case is assigned for the purpose of entering into an appropriate discovery schedule.
