MEMORANDUM & ORDER granting in part and denying in part 50 Motion to Dismiss for Failure to State a Claim; For the foregoing reasons, the Armor Defendants' motion to dismiss is GRANTED IN PART and DENIED IN PART. Smith's deliberate indifference claim arising out his dental treatment and Plaintiffs' HIPAA, RICO, and conspiracy against rights claims are DISMISSED WITH PREJUDICE. Additionally, the Clerk of the Court is directed to TERMINATE Dr. Omanu as a defendant in this action.
