ORDER granting 252 Motion to Dismiss for Failure to State a Claim; granting 256 Motion to Dismiss for Failure to State a Claim; granting 258 Motion to Dismiss for Failure to State a Claim; granting 260 Motion to Dismiss for Failure to State a Claim; granting 263 Motion to Dismiss for Failure to State a Claim. For the reasons set forth herein, the Court grants all moving defendants' motions to dismiss the RICO claims against them, without prejudice. Because the Court has dismissed all federal claims in this action, the Court declines at this juncture to exercise supplemental jurisdiction over the remaining declaratory judgment and state law claims, and those claims are dismissed without prejudice. Finally, the Court grants plaintiff's request for leave to amend its RICO claims. Plaintiff shall file a second amended complaint no later than thirty days from the date of this Memorandum and Order. If plaintiff does not do so, then the Court will order the Clerk of the Court to close this case and enter a judgment for all defendants that is consistent with this Memorandum and Order. SO ORDERED.
