ORDER granting 26 Motion to Dismiss; granting in part and denying in part 27 Motion to Dismiss. IT IS HEREBY ORDERED that, for the reasons explained herein, the motion to dismiss brought by UTS is granted, but plaintiff is granted leave to amend the complaint to include allegations showing that UTS is an alter ego of iTV Media. The motion to dismiss by Lin and the iTV Group is granted with respect to the negligent misrepresentation and intentional infliction of emotional distress claims, and the claim for punitive damages, and is otherwise denied. Plaintiff is granted leave to amend the complaint with respect to the intentional infliction of emotional distress count and/or a claim for punitive damages, and shall file the amended complaint no later than thirty days after the date of this order. ORDER granting in part and denying in part 74 Motion to Compel. For the reasons set forth in the attached Memorandum and Order, the portion of the motion seeking to compel production of documents held by non-party iTV Beijing is GRANTED as to all Defendants, but Plaintiff's request for sanctions pursuant to Fed. R. Civ. P. 37 is DENIED. On or before March 17, 2017, Defendants shall produce the relevant documents in the possession of iTV Beijing.
