ORDER granting 94 Motion to Vacate. For the reasons set forth herein, the Court concludes that plaintiff cannot be compelled to arbitrate her claims against Bay Cities Bank and First Premier Bank. Accordingly, the motion for relief from the Court's June 9, 2014 Order is granted, and the stay of plaintiff's claims against Bay Cities Bank and First Premier Bank is hereby lifted. SO ORDERED. ORDER granting in part and denying in part 125 Motion to Dismiss. For the reasons set forth herein, the Court grants in part and denies in part defendant's motion to dismiss. Plaintiff's RICO New York GBL claims are dismissed for failure to state a cause of action, and the motion is denied with respect to the unjust enrichment claim.
